
HOUSE CONCURRENT RESOLUTION NO. 40

Requesting that the Joint Committee on Government and Finance
conduct a study of the feasibility of creating a State
retirement system for firemen, police officers and emergency
medical services personnel.
Whereas, A number of fire and police departments and EMS
personnel are currently under the State Public Employees Retirement
System, and other fire and police departments are under local
retirement systems; and
Whereas, Having fire, police and EMS personnel participating in
different retirement systems results in inequities to certain
participants in the various systems; and
Whereas, Creating a State retirement system for fire, police
and EMS personnel similar to the Deputy Sheriffs' Retirement System
would eliminate those inequities resulting from having differing
retirement systems for these groups; and
Whereas, The West Virginia Legislature believes that a thorough
examination of the feasibility of creating a State retirement
system for fire, police and EMS personnel would be prudent and
advantageous in assisting the Legislature to make sound fiscal and policy decisions about the future of the State's various retirement
systems; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to study the feasibility of creating a State retirement
system for fire, police and EMS personnel similar to the Deputy
Sheriffs' Retirement System; and, be it
Further Resolved, That the committee shall report to the
Legislature its findings, conclusions and recommendations, together
with drafts of any legislation necessary to effectuate its
recommendations, no later than the first day of January, two
thousand one; and, be it
Further Resolved, That the expenses necessary to conduct the
study and to prepare appropriate reports, recommendations and
proposed legislation be paid from legislative appropriations to the
Joint Committee on Government and Finance.
